The Presnensky Court of Moscow sentenced Interior Minister Dmitry Zakharchenko to 13 years in prison and a fine of 117 million rubles. in the case of taking bribes and obstructing the investigation. This decision was made by the judge Elena Abramova, the RBC correspondent reports. Zakharchenko also deprived of the rank of police colonel and awards, decided Abramova.

The court acquitted Zakharchenko on the episode with receiving a bribe of $ 800 thousand from the restaurateur Medi Duss. The judge explained that all doubts are interpreted in favor of the accused.

The court, however, found it proven that Duss, at the request of Zakharchenko, issued him a discount card to his restaurants, which allowed the colonel to save almost 3 million rubles.

Zakharchenko was also deprived of state awards and for two years was banned from holding senior positions in government bodies.

The defense and the state prosecutor said they intend to appeal the verdict. Zakharchenko’s lawyers will insist on his innocence for all the episodes, and the prosecution intends to prove the ex-colonel’s guilt in the $ 800 thousand bribe episode.

The arrest of Zakharchenko in September 2016 received a wide response because of the amount of cash that investigators found in him and his relatives during searches - $ 140 million, € 2.2 million and 374 million rubles. At the time of his arrest, the colonel was charged only with a bribe of 7 million rubles. from businessman Anatoly Pshegornitsky.

In 2017, the court turned the property of Zakharchenko and his entourage into state revenue - in addition to currency, there were 27 apartments and parking places, four cars (two Mercedes-Benz and two Porche Cayenne) and a half-kilogram gold ingot. The total value of the seized was about 9 billion rubles. - four times more than the sum of all property of officials turned into state income for the previous four years.

The origin of the property for about two years remained unknown, the crimes imputed to the colonel were associated with much smaller amounts. In the Zakharchenko case, a fortune teller with several classes of education, the owner of a chain of elite restaurants and several generals of the Ministry of Internal Affairs became witnesses. Only last fall, it became known that, according to the investigators, Zakharchenko was paid billions in bribes by the owners of the largest Russian Railways contract company, “1520”, which won, according to the Forbes “Kings of state order” rating, tenders for a record amount of 218 billion rubles.

Zakharchenko, who spoke in the debate of the parties for 8–10 hours, did not plead guilty for several days in a row; in his speech, he claimed that state prosecutor Milana Digaev "treacherously distorted the truth."

Fighter against corruption

During his arrest, Zakharchenko worked as acting head of the T management (controls the fuel and energy complex) of the Main Directorate for Economic Security and Anti-Corruption (GUEBiPK) of the Ministry of Internal Affairs. The official earnings of the colonel for all the years in the police (from 2009 to 2016) amounted to 12 million rubles, noted Digaev. “The fight against corruption was entrusted to a notorious corrupt official,” the state prosecutor said in a discussion of the parties before requesting 15 and a half years of strict regime and a fine of 494 million rubles for Zakharchenko.


In this case, Zakharchenko is charged with two episodes of receiving a bribe (Article 290 of the Criminal Code) and impeding the investigation of a criminal case (Article 294 of the Criminal Code). About the bribes after the arrest of the colonel said the owner of the restaurant La Maree Medi Duss - he came to law enforcement agencies, having learned from the news about the prosecution of his friend. Now the businessman is taken under state protection because of the threats he has received; in court, he was interrogated behind closed doors, and the content of his testimony became known only from the retelling of the prosecutor.

Threats from Chuvashia

In June 2017, Duss appealed to the investigator in the case of Zakharchenko Sergey Chernyshev with a request to apply state measures to him. The restaurateur showed the investigation a printout of the email he received; it said there was a “carefully planned and well-organized attempt on the assassination of Mr. Douss for the specific purpose of the murder,” State Prosecutor Digaev pointed out in court. For refusing to kill a man demanded a reward from Duss.

Zakharchenko’s lawyer, Alexander Gorbatenko, stated that the author of the letter was installed, this “certain asocial person from Chuvashia” named Alexander Gavrilov, he was not in any way connected with Zakharchenko and had already received two years for extorting Duss $ 50,000.

“This fake situation was created by unidentified people from among those close to the investigation,” Zakharchenko said.

Currency bribe

The state prosecution believes that in 2014, Zakharchenko and the FSB colonel Dmitry Senin initiated inspections of the tax inspectorate and the Rosselkhoznadzor in the establishments of Duss - they paralyzed the network, and the restaurateur was forced to write off a substantial part of seafood. He turned for help to a friend of the Interior Ministry General Alexei Laushkin. He found out from the deputy head of GUEBiPK, Felix Vasilkov, who exactly created the problems for Duss, contacted Zakharchenko and Senin, and subsequently handed them over to the restaurateur for a bribe. Colonels and Duss bargained on the amount of $ 800 thousand, although initially demanded several times more. The court found this episode not proven and justified Zakharchenko on it.

Subsequently, Zakharchenko invited Duss to a meeting at La Maree on the birthday of the restaurateur’s daughter Sabrina. The restaurant owner realized that he had seen the colonel many times in the establishments of his network. At the meeting, the policeman threatened Duss with “spreading defamatory information” about the quality of his seafood and hinted at a bribe. As a result, the restaurateur took a cash loan in the Education bank, his driver took the bag with the money to Laushkin, putting it in the trunk of the car of the general, and he transferred the money to Zakharchenko.

Seafood Bribe

The problems of the Duss business did not stop after that, said the restaurateur. Zakharchenko demanded from him also a discount card by 30%, and since its design was delayed, the discount had to be increased to 50%. Because of this card, La Maree missed 3.4 million rubles, the state prosecution says.
Indications on Zakharchenko gave and General Laushkin, as well as employees of the Federal Tax Service and the Rosselkhoznadzor and several colleagues Colonel. One of the witnesses was Felix Vasilkov, who worked as the deputy head of GUEBiPK under General Denis Sugrobove and who left the main board after the arrest of the head. He said that he did not consider the actions of Zakharchenko illegal and suggested that Duss "ran himself to give up with money." He described the colonel as a quote from a song by Vladimir Vysotsky: "... He seemed greedy, cunning, clever, carnivorous, he did not know and did not want to take measures in women and in beer." The general added that it was a joke: "Zakharchenko had nothing to do with alcohol."

The state prosecution also proved the guilt of Zakharchenko by deciphering his telephone conversations with Laushkin, Duss and his wife Svetlana - the FSB recorded them at least two years before his arrest.

Colonel's warning

Another episode of the case concerns the fact that Zakharchenko warned his acquaintances of the Nota Bank employees - financial director Galina Marchukova and her sister Larisa - about upcoming searches. In January 2016, the colonel invited Larisa Marchukova to a meeting at La Maree in Protochny Lane and advised her and her sister to hide documents related to frauds in the Electrozavod company, giving them to Zakharchenko’s attorney, Viktor Belevtsova. In the task force accompanying the search, Zakharchenko promised to include his countryman from Rostov-on-Don: he had to control that the search was carried out as it should.

Marchukovy sisters testified on Zakharchenko. Another witness for the prosecution in this case was the fortune-teller Nona Mihai, whose advice was often resorted to by Larisa Marchukova.

The Marchukovs, as well as the bank’s chairman of the board, Dmitry Yerokhin and his brother, and deputy Vadim Yerokhin, became defendants in another case related to the withdrawal of 2.2 billion rubles from the Note-Bank, including funds from Mostotrest. The fortune teller was the author of a scheme for embezzling 350 million rubles, the state prosecution believes. According to his version, the pensioner with elementary education inclined bankers to embezzlement and advised them “at all stages of criminal intent,” using fortune-telling, coffee grounds and praying for their successes.

The defendants received from 3.5 to 8.5 years in prison. Larisa and Galina Marchukovyh were tried in a special order; state prosecution noted that the testimony of the latter helped to uncover another large-scale theft with damage of 25 billion rubles.
 
Case "1520"

In October 2018, a member of the board of directors of Roszheldorproject Valery Markelov, co-owner of 1520, was arrested. He was charged with giving a bribe to Zakharchenko in the amount of about 2.4 billion rubles. Zakharchenko, being an employee of the Ministry of Internal Affairs, actually served as head of the security services of Markelov’s companies, considered the investigation.

Later, in the same case, the court arrested in absentia another co-owner of 1520, Boris Usherovich, a former member of the board of directors of the bank Novoye Vremya, Ivan Stankevich and Dmitry Motorin.

Zakharchenko receiving bribes from the owners of "1520" is now not imputed, said his lawyer Alexander Gorbatenko.

Shareholders of "1520" ranked first in the list of "Kings of the state order-2018" according to Forbes, the magazine estimated the total amount of state orders they received at 218.2 billion rubles.

Colonel's father case

In parallel with the case of Colonel Zakharchenko, the case against his father, Viktor Zakharchenko, was investigated - he was arrested in the spring of 2017. According to the state prosecution, Zakharchenko Sr. was fictitiously employed by one of the leaders of the Moscow Mortgage Agency bank, although in fact he did not work in it. For a year and a half he received 4 million rubles. In the dock, together with Viktor Zakharchenko, was Vladimir Koryevkin, Chairman of the Board of the Bank; another defendant, who replaced him in this post, Sergey Grib, is being sought. Viktor Zakharchenko pleaded not guilty, but compensated the bank for 4 million rubles of damage; the total amount of the bank’s claims is 12.5 million rubles. taking into account penalties and damage to business reputation. Both father and son called persecution an attempt to put pressure on Zakharchenko Jr.

In April, Viktor Zakharchenko was sentenced to four years in prison and a fine of 800 thousand rubles.
