Sergey Polonsky was released from punishment.
Presnensky District Court of Moscow found guilty of embezzlement of a scandalous businessman Sergei Polonsky and his accomplices, but released them from punishment in connection with the expiration of the statute of limitations. The founder of the Mirax Group, Polonsky, sentenced to five years in prison for fraud in business activities in the amount of 2.6 billion rubles, was released in the courtroom. "The next seven days I belong to my wife," said the businessman and added that in the future he intends to again engage in business and "turn the world around".

Initially, it was believed that the announcement of a verdict on a high-profile case could take several days. However, Judge Yevgeny Naidenov immediately went on to announce the operative part of his decision.

The founder of the Mirax Group, Sergei Polonsky, for whom the state prosecution in the arguments of the parties required an eight-year term, was found guilty, but not in a particularly large fraud (Part 4, Article 159 of the Criminal Code), and in a less serious crime - fraud in the sphere of entrepreneurial activity 4. Article 159.4 of the Criminal Code of the Russian Federation). Scandalously known entrepreneur received five years imprisonment, however, since the crime was passed six years, Mr. Polonsky was released from punishment - on this charge expired statute of limitations. The businessman was released from custody in the courtroom.

Similarly, the judge acted in relation to accomplices Sergei Polonsky - ex-head of the financial department of the Mirax Group Alexander Paperno and CEO of Avanta LLC Alexei Pronyakin, for which the prosecution requested five years of the colony and three years conditionally, respectively. Both were also exempted from punishment after the expiration of the statute of limitations.

Note that the defense required to justify all three, stating that there was not the very event of the crime. And Sergei Polonsky expressed his readiness to return the victims of the case money or finish the apartment.

After his release, Mr. Polonsky said that the verdict in his case was "an indicative decision" and that "the future of the country depends on it." He also added that he was glad of his release, and urged people not convicted of non-violent crimes to be imprisoned, since "this is wrong." The businessman said that he was going to return to business. Sergei Polonsky said that in the future he wants to "turn the world", he believes that "the system of education and development of people, which is today in the world, it seriously lagged behind those speeds that are required now." "What kind of people we have - this will be the country. As the lawyer of Sergey Polonsky, Slavik Brsoyan, defense of a businessman can file an appeal against the verdict, but this issue "will be solved after we study the full text of the verdict in writing."

Meanwhile, according to the investigative department of the Ministry of Internal Affairs, which confirmed the prosecution in court, Sergei Polonsky, Alexander Paperno and Alexey Pronyakin appropriated 2.42 billion rubles. In the construction of residential complexes "Kutuzovskaya mile" and "Rublevskaya Riviera" in Moscow. The victims in the course of the investigation testified that they (both from 25 million rubles and more) paid cash both in cash and transferred through banks. They did not see their own apartments. At the same time, in the debate of the parties, the representative of the Prosecutor General's Office figuratively noted that when collecting money for housing construction, Mirax Group actually engaged in "air sales", as it did not have permission documentation for the construction. The charge of fraud to Sergei Polonsky, who was then in Cambodia, was presented in absentia in June 2013. At the same time he was declared a wanted MVD. On May 15, a businessman was arrested in Cambodia, and a couple of days later he was sent to Moscow and placed in the Matrosskaya Tishina detention center. The trial of the embezzlement case actually took place without Mr. Polonsky, who, by court order, was removed from the courtroom for his bad behavior before the debate.
