The main argument of the defendants and their defense in favor of the cancellation of the decision of the Basmanny Court of the capital, which recently prolonged the terms of house arrest, and the mitigation of the measure of restraint was the fact that all the investigative actions had already been carried out. Now the accused get acquainted with the materials of the investigation, and, therefore, can no longer exert pressure on witnesses or in some other way obstruct the implementation of justice. Ms. Apfelbaum also noted that detention under house arrest does not allow her to fully engage in the child. Figures asked to release them under a written undertaking not to leave the place, Sophia Apfelbaum expressed willingness to pay a 1 million ruble deposit for release.
And Kirill Serebrennikov, who called the criminal prosecution of the defendants "civil execution", asked the court in case of rejection of the complaint at least to mitigate the conditions of house arrest, in particular, allow him to go to work or use to communicate with colleagues online.
The prosecutor's office and the representative of the investigation insisted on rejecting the complaints. In particular, the representative of the supervisory authority noted that the witnesses in the case can not be pressured only after they give evidence in court during the consideration of the case on the merits. In addition, law enforcement officials did not exclude the possibility that, being at large, some of the defendants may disappear.
As a result, the Moscow City Court rejected the complaint, leaving the conditions of detention of the defendants under house arrest unchanged. "The decision of the Moscow Basmanny Court to extend the measure of restraint in the form of house arrest against Serebrennikov in the form of house arrest, while retaining all previously established restrictions," the judge said.
Under house arrest there is also the former chief accountant of the "Seventh Studio", Nina Maslyaeva, whose testimony formed the basis of the accusation. A former general producer of the studio Alexei Malobrodsky, during the whole investigation was in jail, recently after a heart attack was released under a written undertaking not to leave the place.
Recall, according to investigators, in 2011, director Kirill Serebrennikov developed a project "Platform" for the development and promotion of contemporary art, for financing in 2011-2014 the Ministry of Culture of the Russian Federation allocated more than 214 million rubles. To implement the project, the ANO "The Seventh Studio" was created, in which Alexey Malobrodsky, Yury Itin, Nina Maslyaeva and producer Ekaterina Voronova worked (listed on the wanted list).
As the Investigative Committee of Russia believes, by overstating the quotations for works and props, as well as providing fictitious financial reports to the Ministry of Culture, which was claimed by the employee of the department Sofya Apfelbaum, about 130 million rubles were stolen by the defendants. In addition to Nina Maslyaeva, none of them does not admit guilt.
