The fraud in the Fundservicebank was estimated at 7.5 billion rubles

Alexander Volovnik and Peter Ladonshchikov are accused of creating a criminal community. Former "space" bankers do not agree with this.
The Investigative Department of the Ministry of Internal Affairs has completed an investigation into the circumstances of the embezzlement of 7.5 billion rubles. in Fonderservbank (FSB), the main customer of which was "Roskosmos" for a long time. 12 defendants, including the former owner and head of the bank, Alexander Volovnik and First Vice-President Peter Ladonschik, are accused of organizing a criminal community and participating in it, as well as of particularly large-scale fraud. The defendants themselves deny involvement in illegal operations, insisting that the bank did not have any criminal schemes for the withdrawal of assets, and those actions of bankers that the investigation considers criminal, corresponded to their official duties.

After the completion of the investigative actions in the Fondservisbank case, the investigation materials amounted to about 200 volumes. The defendants of the case are charged with a particularly serious art. 210 (organization of the criminal community and participation in it with the use of their official position), as well as under Part 4 of Art. 159 (fraud in a particularly large amount) of the Criminal Code. It should be noted that one of the 12 defendants - the former general director of the Metropolitan Trust Company Soyuz and a member of the board of directors of Fondservisbank, Eduard Chesnov - is on the wanted list and arrested by the court in absentia. According to the investigation department of the Ministry of Internal Affairs, which carried out the investigation, the damage from the activities of the TSO amounted to 7.5 billion rubles.

According to Kommersant’s sources, the case file states that in May 2013 the owner and first president of the bank formed a criminal group whose goal was the “systematic theft of money” of the FSB. In addition to bank employees, the OPS creators, according to the investigators, used the Stolichnaya Trust Company Soyuz LLC, the Automation of Business Processes LLC, the FINSO Managing Company LLC, as well as the one-day companies as the “tool of committing crimes” . At the same time, it is said in the case, the criminal community was divided into several "separate groups" - according to the specialization of its participants. Thus, according to investigators, employees of Automation of Business Processes looked for one-day firms, prepared packages of documents necessary for processing credit agreements for them, and then controlled the transfer of bank funds to the accounts of these companies “under the guise of civil law transactions” . Then they destroyed the documentation on the activities of creditors. At the same time, the group itself, it is noted in the materials of the investigation, was also divided into subdivisions - legal, accounting and security department.

The group, which, according to investigators, was headed by the general director of STK Soyuz, Eduard Chesnov, dealt with various financial operations with funds stolen from a bank, managing property “acquired by criminal means”, as well as “accounting and distribution of criminal income” among participants of frauds.

The division, which, according to the materials of the case, controlled the management of the FINSO MC, not only provided preparation of documents for embezzling the bank’s funds by issuing knowingly non-repayable loans, but also, according to the investigation, with this money was engaged in various operations on the securities market “in order to conceal crimes ".

Finally, the security team, which, according to the detectives, was led by the head of the department of resource protection of the FSB, ensured conspiracy, prepared inspection reports and other documents “containing false information” in relation to the one-day companies to which the FSB money was withdrawn. And the loan processing group was engaged, according to the case, in “hiding traces of systematic embezzlement,” issuing positive conclusions, professional judgments, etc., necessary to give the appearance of legality to the issuance of non-performing loans.

As a result, as follows from the case file, members of the group, following the instructions of the owner of Fondservisbank Alexander Volovnik and the first vice-president of the bank, Petr Ladonschikov, found 31 one-day companies for withdrawing funds from May 1, 2013 to February 24, 2015 216 loan agreements were concluded. According to them, the bank transferred 6.7 billion rubles, which were then “not returned to the bank”: the money, according to the investigation, was used by the members of the criminal community “at their discretion”. Moreover, in November 2014, in the bank building (Butyrsky Val, 18), according to the investigators, a scheme was drawn up for withdrawal of 800 million rubles. "By signing a fictitious contract" with UK FINSO, who were also kidnapped. Thus, the total amount of damage in the case amounted to 7.5 billion rubles.


It is worth noting that for ten years the FSB was the main bank for Roskosmos, which at that time held $ 800 million in its accounts. The bank served almost all of the largest industrial enterprises, salary projects and currency accounts of Roscosmos. The problems of the FSB began after in 2015 the new leadership of the state corporation demanded the return of the funds placed in the bank, but in response it heard a proposal to wait for three years, since the money was invested in various projects. The then Deputy Prime Minister Dmitry Rogozin (now the head of Roskosmos) said: “There were intelligent people (I’d not call them fools) who created all sorts of schemes under which the money earned by the country for space launches was decanted or personally in your pocket by this space chiefs, or in one bank, which had no relation to state control. ” And he added that in this financial structure "hundreds of millions of dollars earned by the country" settled down.

The management of "Roscosmos" appealed to the Central Bank with a request to understand the work of Fondservisbank. After the audit, which, according to the then Central Bank chairman Mikhail Sukhov, discovered “facts of a substantial over-valuation of assets”, the FSB fell under a reorganization program conducted by Novikombank. He was offered as a sanator by Roscosmos himself, agreeing at the same time to freeze part of his funds placed in Fondservisbank.

Persons involved in the case do not admit guilt. They argue that all financial operations conducted by the FSB were legal, and the investigation considers their actions that conformed to the official duties of the accused to be criminal.
