German concern Bayer sued the Federal Antimonopoly Service (FAS) of Russia, the application was registered on February 8, it follows from the information in the file of arbitration cases. The company demands to recognize the FAS decision as illegal, it is indicated in the case file. Which decision is dissatisfied with Bayer, the card is not specified. As third parties, Monsanto, Monsanto International and Monsanto Rus are listed on the card.
Information on the claim on Tuesday was confirmed by the head of the FAS Igor Artemyev. "The largest company, German Bayer, which merges with Monsanto, just sued us," he said at a meeting with United Russia deputies in the State Duma (quoted by Interfax).
According to Artemyev, FAS earlier demanded from the German concern "in exchange for the consent of the antimonopoly authority to transfer a significant part of the technology" to the Russian agro-industry. "They have such a bigdata that if they are launched in a unified form, we will have very little left from agriculture," explained the head of the FAS.
According to him, this is the first FAS court with Bayer. The company said that they are ready to not make a deal with Monsanto on the territory of Russia, "they are ready to leave Russia," Artemyev said.
In November 2017 FAS obliged Bayer to share with Russian agrarians seed selection technologies necessary to create new varieties and hybrids that are applicable in the Russian climate. FAS also demanded to provide a database for digital farming. As Bloomberg wrote, this is the first time in the world practice when a regulator needs to exchange commercial data and technologies for access to the national market.
The deal was signed by Bayer and Monsanto in 2016. The deal was then valued at $ 66 billion. The merged company will become the world's largest producer of herbicides and genetically modified seeds. According to the FAS, this will create significant risks for competition in the Russian market.
