As it became known to Kommersant, in Novosibirsk the investigation of the case of the well-known entrepreneur Natalya Zhdanova, co-founder of the SLK-Motors group of companies, was completed. Ms. Zhdanova was charged with causing damage to customers in the amount of over 70 million rubles. Natalya Zhdanova did not agree with the accusation. In her opinion, all claims could be removed by an economic examination, but it was refused. While the investigation was ongoing, the supplier - Toyota Motor LLC - settled with the vast majority of victims.
In Novosibirsk, the founder of the SLK-Motors Natalia Zhdanova will face trial. The basis for bringing her to criminal liability was the numerous statements of the holding's customers - both individuals and companies. Back in 2015, they made an advance or the full cost of a foreign car, but the car did not receive it. According to security officials, the total loss to customers of SLK-Motors amounted to 71.3 million rubles.
About one hundred episodes were combined in one thing. It was initially investigated under an article of the Criminal Code of the Russian Federation on fraud (Article 159). However, the facts of the theft were not established, and the prosecution was re-qualified to the 201st article on abuse of authority. The final charge sounds like causing particularly serious property damage (Article 165). According to the investigation, the money that new customers brought to the car dealership went to purchase cars for customers who paid earlier. In addition, according to the investigation, part of the funds received from customers was used for the current financial activities of the holding and was spent on servicing loans received.
Investigators signed a written undertaking not to leave the place of Ms. Zhdanova. Denis Gorodilov, deputy prosecutor of the Dzerzhinsky district, told Kommersant that the property of the car dealer was seized — the building of a car dealership with an area of about 15 thousand square meters. m and worth about 200 million rubles.
Natalya Zhdanova did not agree with the indictment. “It follows from the prosecution that in 2015, SLK-Motors delivered more than 600 Toyota and Lexus cars to customers. Several buyers did not receive the cars for technical reasons - a delay in manufacturing, a lack of color from the supplier, and a change in model line. The delivery dates were postponed to 2016, but at the end of 2015, the general distributor - Toyota Motor LLC - terminated the dealer agreement with SLK-Motors CJSC, as a result of which the holding lost the right to officially sell new cars. Most of the buyers were given cars, some of the buyers returned the money, and the rest turned to the court and the police. All claims are civil in nature. No evidence of cash withdrawal, withdrawal to one-day firms, or appropriation by the investigation was found. The investigation lasted two years, the accused submitted all financial documents and repeatedly requested an economic examination, which was refused, ”lawyer Sergei Nikolaev told Kommersant. The defender noted that to date, Toyota Motor LLC has returned the money to all private individuals, with clients from among the companies, of which there are only three, the issue of compensation has not yet been resolved.
In early August 2019, the investigation into the case that the Dzerzhinsky police department of the Ministry of Internal Affairs in Novosibirsk was engaged in was completed. According to Denis Gorodilov, the prosecutor's office approved the indictment in the case (the volume amounted to over 80 volumes), his hearings will be held in the Dzerzhinsky district court.
SLK-Motors Group of Companies was established in 2004 by Natalya Zhdanova and her two business partners: Dmitry Malakhov and Andrey Andreev. Both of them left the company at different times. The group was one of the largest car dealers in the region. Her portfolio included Toyota, Nissan, Hyundai, Lexus, Audi, Volvo, Ford, Lada, Mitsubishi and Porsche. However, from 2012 to 2015, the group began to abandon dealerships. Natalia Zhdanova herself explained to the media these decisions by the fact that the car market has sagged significantly and the company is optimizing its portfolio of automotive brands. Around this period, claims began to come to the structures of SLK-Motors. The total amount of current and overdue debts of the group at that time was called in the amount of 2.5 billion rubles. At present, for a number of holding companies, the bankruptcy proceedings have already been completed.
Debt restructuring in respect of Natalia Zhdanova was introduced in August 2016 at the suit of Arkady Andreev, the father of the former business partner of Mrs. Zhdanova, due to a debt of 26.3 million rubles. In March, the Arbitration Court of the Novosibirsk Region declared Natalya Zhdanova bankrupt and introduced a property sale procedure for her. As of April 2019, the total number of creditors' claims included in the register amounted to 2.4 billion rubles. Currently, the procedure for selling the property of Natalia Zhdanova is not completed.
