A businessman is confident that business can be saved. One option is to transfer the part of the retailer's real estate to creditors. But lawyers doubt that banks need assets that burden the balance.
About the intention of Alfa Bank to bankrupt the owner of the Holiday network Nikolay Skorokhodov, Kommersant learned from a notice in the SPARK-Interfax database. This was preceded by the bank's request to pay back overdue debts of about 2.8 billion rubles. At the end of July, the Arbitration Court of the Novosibirsk Region introduced the procedure for monitoring the claim of Alfa Bank to LLC Holiday Company. In addition, about 10 creditors with a total amount of claims of 30 million rubles were declared in the bankruptcy case of the retailer. The press service of Alfa Bank declined to comment.
Holiday is one of the largest retailers in Siberia. Its network includes 341 stores in Novosibirsk, Omsk, Kemerovo, Tomsk and Tyumen regions, as well as in the Altai and Krasnoyarsk regions (about 500 years ago). In 2017, the retailer put up for sale all its supermarkets and hypermarkets - more than 150 objects with a total area of about 300 thousand square meters. m. "The intention to initiate personal bankruptcy is expected, I am ready for it," Mr. Skorokhodov said. "But so far, Alfa Bank has no legally binding decision to recover from me, as a guarantor, debt on loans." He believes that the intention of the bank will not affect the process of negotiations with creditors, which are co-owners of the company. Nikolai Skorokhodov said that the way out of the bankruptcy procedure is possible only by concluding a settlement agreement. "Bankruptcy is not beneficial neither to creditors, nor to the company itself," the businessman argues. In his opinion, one of the solutions to the problem is the transfer of the company's assets, including retail space, land plots and own truck fleet to creditors. About 60-70% of real estate is pledged to Rosselkhozbank, Alfa Bank, Sberbank, Gazprombank. "Loans are more than secured," says Mr. Skorokhodov.
The transfer of some of the real estate to creditors is not a very common way of settling debts, says Dmitry Kletochkin, partner of the legal company Rustam Kurmaev and partners: "Banks do not need such assets, they burden the balance."
